Seriously - Just take some deputies and serve the subpoena on them. If they don't come willingly, just take them.

I'm so sick of hearing about political clowns just giving the finger to subpoenas.

/That goes for everyone.

No doubt. Alaska is tiny - more like a biggish town than a state. There's no way they can defend themselves against a national political organization. they lack the depth of sharp politicians and lawyers.

Calvin Coolidge 2008-09-20 06:44:29 PM
Can someone explain why Todd Palin isn't being thrown in jail for ignoring this subpoena? Is it because the subpoena is from the legislature and not a judge? Or is it just because he's the husband of a VP candidate is apparently outside the law?

The people who choose to ignore these subpoenas should be held at Gitmo and questioned there.

So a governor of such a state wouldn't be nearly as experienced or savvy as, say, a "newbie" who has managed to survive the rigors of the Chicago political machine and hit the national scene running?

you can be arrested for ignoring a subpoena, but the legislature must order the arrest. The Alaskan legislature is not in session, is the problem, as far as I understand the problem.

McCain-Palin campaign spokesman Ed O'Callaghan announced that Todd Palin will not comply with a subpoena to testify about his role in Troopergate, the Legislature's investigation into whether Palin abused her power in forcing out former public safety commissioner Walt Monegan.

All I know is that if *I* tried to ignore a subpoena I'd be in jail right now.

So how come this guy gets a free pass?

I hope since nobody associated with Governor Palin will honor the subpoenas, they will decide the case on the evidence presented against her, find her guilty, then draw her up on charges of impeachment.

Actually the Illinois Senate meets in Springfield, not Chicago, Obama was state senator for 8 years.

The "Chicago political machine" died with Daley (Sr).

Where I come from, if you "refuse a subpoena" you get a bench warrant and a mailed summons, and if you "refuse" those you get cops knocking your door down.

I did, it and wiki says it only applies to civil and criminal cases.

The real issue if you care:

Ignoring a legislative subpoena is punishable by a fine up to $500 and up to six months in jail under Alaska law. But courts are reluctant to intervene in legislative matters and the full Legislature must be in session to bring contempt charges, Wielechowski said.

I'm so tired of hearing this bullshiat everytime a Republican ignores a subpoena. It doesn't matter. A subpoena means you SHOW UP, regardless of how stupid you think it is. That's the law. Republicans don't get to decide which subpoenas they think are not worth their time.

Ignoring it makes them look even worse. You've got nothing to hide? You think it's partisan bullshiat? Then show up and show us all how stupid it is. Answer their questions fully and truthfully and demonstrate that it's nothing more than a partisan witchhunt.

I don't care how stupid a subpoena seems, they have NO RIGHT to ignore it. It's called "respect for the rule of law." And if the shoe were on the other foot, you'd say the exact same thing. "I'm not showing up for your trial because I'm innocent" just doesn't cut it.

No, spousal privilege doesn't apply. The "First Dude" was included in official government business.

Palin is also claiming executive privilige in refusing to disclose emails (new window) which were copied to a private citizen known as the "First Dude".

It will be transparent. Just like Bush. Granted you will have no idea what's actually going on. But they will give you a story, and 'facts' and a justification for actions. None of which have anything to do with anything, though they will be a good story and provide just enough ummph to get people to kind of agree with what they think they are attempting to get at. Oh yeah, transparency, you'll be able to see right through it.

(a) X is illegal under the law, punishable with fines and prison;

(b) Political official P just announced that s/he will do X;

(c) The reason is that P knows there will be no consequences for X.

That's the elimination of the rule of law and core democratic processes expressed in elementary logical terms.

I agree, I know how it works. I'm just tired of this outrage that some of us should even expect them to respond to a subpoena. As if people like Palin are in a position to decide when the law should apply.

The Attorney General is refusing to recognize them so even if some enterprising (and frankly ballsy) cop actually arrested them the AG's office would refuse to prosecute. Looks like Palin learned from Bush about making sure those who enforce justice are nothing more than indentured servants to the chief executive.

Spousal privilege is revoked in any communication that involves a third party, so all those e-mails he was copied to are fair game.
