"If someone is flouting the law, it can be difficult," said Mira Gamsa of the tribunal.

If only there were some place to send people who violate the law.

You would think being literate would be a prerequisite for becoming a landlord, but apparently not.

/hope the publicity helps the tenant.
//poverty, of both mind and pocketbook, is sad though.

FTA: "I can't read or write," said Gilbert, who said he works in construction and claimed that Davis had not paid him rent.

"He was supposed to pay me $800 a month, but he only ever paid me $200 to $300 a week," he said.

When it was pointed out that that amount comes to at least $800 a month, Gilbert shrugged.

How does he manage to dress himself without choking?

Can't read, can't write, can't add. He's a triple threat.

And we thought AMERICAN schools were in trouble? Or, maybe it's just that his father isn't the only one suffering from dementia.

FTA: "I trusted the system, I put my faith in the system, and the system, to put it quite frankly, sucks."

They always do.

I'd rather get paid $300 a week than $800 a month, but that's just me.

OK, he was sophisticated enough to get power of attorney for his infirm father but not to be able to figure out that $200-300 a week is actually more than $800 a month?

Can't the tenant get a lien on the duplex for the judgments? Seize the property, toss out the (former) landlord, problem solved.

My last apt complex manager was so ... what's the word. Stupid, illiterate, inept, all of the above.
She sent out an announcement about the monthly neighborhood watch meeting.
It was so bad, I had to scan/print and take a copy in to work. Watching my coworkers try to actually read it was funny.

I've read writings from 5 year olds that were constructed better.

Kygz 2008-09-13 03:12:31 PM
If he can't read or write how did he write up the three year lease this tenant signed?

/kind of reminds me of the time James Brooks went to court for not paying his child support and claimed he didn't know he owed anything since he couldn't read. The judge noted that Brooks had gone to Auburn for four years on a football scholarship. Auburn had no comment.

bnoogie 2008-09-13 03:16:39 PM
If the tennant is a construction worker(as the article says)... he should do the repairs, send a bill to the landlord who will swiftly not pay it, then he can put a contractor's lien against the property and get the entire duplex awarded to him in a court settlement... then evict the "landlord," who is now the tennant and then profit...

Loquisimo 2008-09-13 03:18:34 PM
And it's hilarious that their names are Davis and Gilbert! Get it? Oh yeah, I'm the only one on Fark who's studied geomorphology. Well, it's funny, and I'm a dork.

There was a sign in my last apartment's laundry room:

PLEASE DO LUANDRY
WHEN YOU HAVE TIME
SO OTHER TENANTS CAN
DO THERE LAUNDRY

I did my laundry when I didn't have time, just to show her!

cr0sh 2008-09-13 03:24:21 PM
Personally, I think the tenant is the idiot here.

Apparently this guy (the landlord) can't add. The tenant now knows this. If the landlord can't add, and he can't read, he probably only knows that a certain number of bills (four or less, would be my guess, given what we know of certain societies/indigenous tribes who can't count past 2 or 3, having a term meaning "many" after that - IIRC, crows are like this, too) means "800".

So - give him that number of bills each month. But instead of giving him the proper denominations, give him lower ones. He'll be happy, the tenant will be happy, everyone's happy.

/until the bank says something...

There's a lesson to be learned here...

"Don't rent from a person who can't read or do basic math?"

Seems a good start.

Good Behavior Day: Can't the tenant get a lien on the duplex for the judgments?

From TFA, the house isn't registered in his name, it's in the name of the senile father. Like a leased car, the house is judgement-proof.

The battle - over a duplex that has had no power, water or heat for nearly that long -shows no sign of ending any time soon, despite the involvement of the provincial agencies and boards that are supposed to be able to police such disputes in Ontario.

Do you totally forget and start reading anew after each sentence? The sentence immediately preceding that one provides the context you're looking for.

If that is the case being in the name of the senile father, then the actual judgement would be against the father ultimately b/c the "landlord" was acting as an agent for his fathers affairs and performing business for him. So he could put a lein against the house...in America anyways....Canada is another story....

Whadjisay 2008-09-13 04:17:58 PM
Geez what a wuss...
5 gallons of gasoline and a book of matches would solve the problem quite nicely.

It might be that he has to hound this guy for back rent every week. And the guy just gets another paydal loan. Granted, hes paying the amount monthly, but instead of just paying once a month, the landlord needs to keep calling over and over and demanding his money. Ive had tenants like that. Theyre terrible people. DOnt sign the lease if you cant pay.

Cheviot 2008-09-13 04:29:46 PM
The landlord owes the tenant thousands and thousands of dollars, plus thousands in rent abatements. It's likely that even if the tenant doesn't pay a penny of rent in the next two years, he will STILL be owed money by the landlord.

I wouldn't be paying him either.

$800 per month x 12 months = $9600 per year, but

200 per week x 52 weeks = $10,400 per year.
