I liked Bill Engvall's idea, but instead of applying it on airplanes, apply it everywhere.
Just have someone carry the skinny part of a fishing rod, and whenever someone does something stupid, just pop 'em on the neck.

If the name of the feature wasn't an indication of its danger, you should do the world a favor and off yourself.

I'm a plaintiff's side attorney, and it really makes me scratch my head when I read about these cases. Unless she sued without representation (pro se), what sane attorney hears this during an intake appointment and thinks that it's a case worth taking?

I get these people coming into my office on occasion, where, due to an astonishing lack of common sense, they suffered an injury and now want to sue someone for it. It takes more than a little self control to not lecture them about the dangers of stupidity and berate them for wasting my time.

These are the kinds of cases that make people hate attorneys. Sheesh.

I think she might have had a valid lawsuit, but she filed it against the wrong people. From the article it seems likely that this was part of a birthday prank where her 'friends' blindfolded her and took her someplace to lead her around, still blindfolded. She put her trust in these friends and they let her down. The real guilty idiots are the ones that put her in that position. Of course, the state had deeper pockets than her friends....

She landed in a stream, where she remained for about 90 minutes before rescue crews could get to her.

The state should sue her to recover costs associated with the rescue. Or a taxpayer should as it is our money spent to get her out of a jam that she caused.

And this thing about the blindfold: someone is obviously lying. Isn't perjury a punishable crime?

I dunno. I recently slipped and fell at a store, there was a puddle on the floor that I didn't see, I got bruised up and my elbow still hurts. It's been over a month and I still have shooting pain down my arm. I'm pretty sure that's not normal. The insurance company still isn't even willing to pay my medical bills.

I know there are stupid people out there, but if someone slips and falls when they were doing nothing wrong and were just going about their business, it shouldn't take a farking lawsuit to get medical bills paid. There's a difference between people suing just to get easy money and being a dickhead insurance guy because you can be.

I know this is kind of off subject, but I'm pissed off at them and my arm farking hurts.

OK maybe I read the article wrong, but did it not say that she was blindfolded because her guy-who-was-a-friend kept her blindfolded the entire time? ( even though she said she wasn't )

So, while I agree it was not the States fault in any way, if she should go after anyone it should be him.

A couple of years ago, I went with some friends to Asateague Island to see the wild ponies and we saw a first-hand example of this kind of stupid. There was a foal grazing a short distance away from a group of mares and a stallion and this guy was dragging his young son over to "pet the pony" despite the signs that explicitly say not to approach them. The kid was crying and the adult horses were pacing and obviously upset but he kept insisting "Go ahead. It's just a little guy. He won't hurt you" until the stallion was forced to lunge at him. Fortunately, he just wanted to scare the man and not hurt him because he or the kid could easily have been kicked or bitten. The man looked so offended and surprised ("oh, THAT one isn't very nice!") that I'm sure he was the type who would have demanded compensation if something had happened.

Actually:
1) She was a passenger, not driving
2) as far as I know, it's unknown whether or not the car had cupholders
3) she placed the hot cup of coffee between her (pointy sharp) knees, not her legs. This is important, as her (hard) knees made a nice pivot which the cup could turn on. If it had been between her legs, which have muscle and fat on them, the cup would have been held better, and would not have tipped.
4) The cup did have a warning on it. (This is ignoring the fact that any idiot knows that hot coffee is... hot.)

Never under any circumstance would I let my "friends" blindfold me and lead me into the wilderness. That is clearly stupid and reckless on her part as well as theirs. No one should be sued for a lesson she learned the hard way.
