...and people wonder why I had to rethink my views on capital punishment?

As an idea, I can accept the basic premise of capital punishment. Get the folks out of the gene pool, toot sweet, and be done with it.

The problem is the fairness of the current application. Not for how cruel it is. Not for how barbaric it is. But with the fairness that the courts apply it. Until that issue can be resolved, a thinking and fair society should stop with the executions, fix the system, see to addressing the issues that plague the system, and THEN get back to it. Not continue to limp along, and apply a biased and often flawed system with aplomb, and congratulate ourselves on being "tough" on crime.

China is tough on crime too. So is Singapore. Doesn't mean they are fair or right. If we want to take the moral high ground, we have to actually occupy that territory first...

I think you've phrased it well, and it's almost exactly how I feel on the subject as well.

The only disagreement I would have is that the current lethal injection protocols need to be updated to prevent mistakes, which can lead to unnecessary side effects while trying to kill someone. It wouldn't be very hard to devise an injection administered by professionals that would off someone with little to no complications every time.

Of course, that's a moot point while we're administering what is currently an unjust system.

To be honest, I am worried least about how humane the system is. From a logical standpoint, at the point of the decision that execution is a go, the cheapest thing would be the gallows or two in the back of the head.

The idea of the electric chair, the guillotine, lethal injection, all of these are ways supposedly to "humanize" the act of killing a person for their crimes. To remove folks from the act--and thus, as the agents of society, remove us from the act.

That is, I think, a mistake. If we can't accept the idea that we as a society are pulling the trigger, then maybe we shouldn't be doing it in the first place. These are dodges to make people feel better. It's not a person, our agent, who is doing it, but a device. A machine. We push the button, but it's a less personal way of doing it, and that remove I think insulates folks from the decision to kill.

And if we cannot handle that decision, then maybe we shouldn't do it.

So long as there is a far enough remove. Soldiers killing for us are fine--so long as it's done off camera and we don't have to see the results. The police killing, that's fine, so long as it's off camera. The same can be said for executions. Off scene, and we're good with it.

There's a reason that the Vietnam war came to such a screeching end. When people actually saw what was going on, then they started to get a little antsy. We've handled news coverage very well since then of our conflicts. Much more managed, because if people actually knew what their troops faced every day, their sons and daughters dealt with day to day, then they might just lose their stomach for sending them off.

The practice for experienced counsel, as I understood it, was to get together with the other side, set up a meeting with the judge and confirm that both sides made the same contribution to the judge - to ensure a fair trial. The rumor was that extra donations were made from time to time without the other side's knowledge...

And he'll probably get reconvicted if given a new trial. Just because he's probably guilty doesn't mean his trial was fair, or that he didn't deserve a fair trial. If your trial renders the right verdict for the wrong reasons, it's still a miscarriage of justice.

No matter how damning the some of the evidence may appear, no one should have to give up their life without a fair trial where all the evidence can be evaluated.

He probably got a fair trial. But with the judge an prosecutor sleeping with each other, we can not be sure the judge did not show favoritism toward the prosecution. So give him a new trial

We don't need to be so quick to kill that we skip making sure the trial was fair.
