this reminds me of the Married with Children episode where the burglar that Al beat up sues him, so Al punches him in court and countersues for damage to his hand. In other words Amtrak should sue him for unauthorized use of their electricity as well as damage to the top of their train cars.

There's a very famous (i.e., used in many tort textbooks) US tort case similar to the one in the article where the guy who was injured while "trespassing" was actually moved onto the restricted area while getting his ass beat and the question that came out of it was whether trespass must be voluntary. Anyone remember the name of that case?

Geez, cases like these just make me so damn sad!
How can that even be allowed to go into court? Dumbass moran got himself electrocuted while trespassing and trying to commit other crimes. The fact that he was too stupid/drunk to find a safer work environment for his nocturnal activities, should be enough to simply throw the case out the window... and him right behind it.

There should be a huge whopping clause in the law, saying that injuries sustained while committing crimes/felonies are only to be blamed upon the criminal. End of story.

Then again, where would we get our FARK material?

From what I got from the article,he was an architect who got blinding drunk,tried to open a train so he could get back home around 2 am,and when that failed climbed on top where he "met" the 27,000 volts.

So at 25,he's burned,with an amputated leg...unemployable. Unless he scaled a fence to get to that train...he might have a chance in court from a sympathetic jury.

Drunk,stupid,but not criminal.

Mmm, everyone seems to be a bit holier than thou here. I've done a lot dumber stuff when I was completely sloshed than just climbing on top of a train. I know you have too.

Becoming completely disfigured seems a bit harsh for punishment.

I'm not saying they should sue, but you WOULD think Amtrak would cut the power supply when the trains aren't in use.

No railroad anywhere powers off out of use tracks. And if it was sitting there parked with the pans up on the locomotive, it wasn't being parked long anyway.

The reason why you can see people working on the third rail in Montreal after a train passes is because the voltage is low. 750V DC doesn't push through much. 25 - 27kv, that WILL.

And, in Boston, the idiot got between the wire and the train body, which is a return path on most electric trains.
