You've got a valid point, but it's different in Florida. The Castle Doctrine provides for civil immunity in these kinds of cases. The would-be truck theif cannot sue for ANY damages whatsoever; and had the owner killed the theif instead of trapping him in a toilet, the theif's family would be unable to sue for any damages.

Even if he gets E. coli from the toilet water, he's shiat out of luck.

It was a construction site, so I'm sure there was rope or wire that they could have tied around it to keep the door shut. So the argument would be that they went further than needed to detain him. They were not officers of the law, they weren't security guards, they weren't even loss prevention agents of a retail store.

That's my thinking, I'm not positive on that.

Trespassing in a construction area is a felony under FS 810.09. They had every right to detain him.

Also, in the time it would have taken to find rope or wire to keep the door closed, he could have escaped. Easier to just tip the porta potty over with its door on the ground.

I live in Tampa, and frequent International mall. I love the castle doctrine because it gives the victim of a crime the upper hand every time. I would have done the exact same thing these guys did, with the added security of having a pistol on me incase this guy tried to pull something to get away. Just because you are immune from charges does not mean that you should always choose to kill when it is not necessary.

I looked this guy up on the Hillsborough county sheriffs website and he has been arrested 14 times for multiple felonies over the last few years, and he is only 22 years old. Hopefully the horrible ordeal he had to go through, followed by the national embarrassment that is sure to follow will make him clean up his act. There are too many of these thugs on the street, and if this is not enough to make him change his ways then hopefully the next guy he tries to rob puts a bullet in his head.

/Sick of multiple repeat felons out on the street doing the same thing over and over after getting slaps on the wrist.
