Along with a pointed stick?.

Doesn't a HOA defeat the purpose of suburbia? Just move to a decent size city and live in a co-op. Jesus.

Seeing as how house prices have plummeted across the nation, aren't HOA's proven to be ineffective?

Can't we just dispose of them entirely?

Say all the bad things you want about HOAs, but you'll sing a different tune when you get a neighbor who keeps 200 cats, parks an 18-wheeler on the streets, or decides to paint his house pink.

Good for the board. People do not realize, for some stupid reason, that if they own a house in the HOA, that THEY ARE THE HOA.

Not attending the meetings does not fark the HOA board; these idiots are only farking themselves.

By the way, when someone sues their HOA, they are not suing the board; they are suing themselves and their neighbors. Get it, kids?

What do they plan on doing with the money if they actually collect any? I mean, by the looks of things if they actually get everyone that doesn't show up to pay that fine that's a few grand just sitting around.

Since I'm not a home-moaner, I guess I'm just not sure what the purpose of an HOA is... why do they exist at all?

I don't know why we need to have these HOA discussions. Its not like a homeowner is suddenly surprised by being locked into an HOA. The terms and conditions of an HOA are always in the mortgage documents at signing. If they failed to read, its their own damned fault.

It really is quite simple. Don't like an HOA, don't buy a house in an HOA'd neighborhood. Like HOA's, buy a house in an HOA neighborhood.

/ But this is fark so I suppose we will have the usual suspects who will rail for/against HOA's because they like/don't like their mustangs up on blocks in their front lawn.

I wouldn't care just so long as they keep it within the law. HOA's reek of elitism, but then again I guess co-ops do too. Course, I bought my apartment from a sponsor, so the co-op board had no say. Mwahahaha!

At least they have a board meeting that they can attend.

Here, my "HOA" is actually a property management corporation in Michigan. They charge ever-increasing dues in order to send a lawn-Nazi around once a month to make sure that our lawn is mowed to within 1/8th of an inch of the proper height, nobody has built a moat around their house or installed a machine gun nest on their roof. God forbid that someone should install the wrong color or type of carriage lamp by their garage!

And we have no say whatsoever in this.

When my roommate had this house built six years ago, he was told by the builder that he would be notified when an HOA was selected.

He had no idea or warning that it was going to be a property management corporation.

It amazes me that no city council or county commission has not tried to pass legislation limiting the power of HOAs. With the drought conditions over the last two years in NC, a lot of people have begun stockpiling rain barrels, which seems to piss off HOA boards. I'm waiting for the State Assembly to pass a law forbidding HOAs from preventing homeowners using "green" practices.

tampaflacouple: The newest branch of the terrorist in America, The HOA.

Pretty much. A random few do some good; most are like those down here in the OC with rules like: You must have a natural green lawn that covers 80% of your yard with no dead spots.

So if someone wants to plant a native-plant garden? SOL! Voluntary water rationing? SOL! Wants to go green and put in artificial turf? SOL! And just try getting around the HOA's rules. They are harder to change than the Constitution. Some places up north, with mandatory water rationing are even worse: They CANNOT water their lawns, which are dying, and the HOA's are fining people hundreds of dollars even though the state of CA WILL NOT allow people to water. SOL! smile the HOA's, you signed the agreement!

Fascist doesn't begin to describe it.

Right. HOA's are private contracts between consenting adults. "We" don't have any standing to support or "get rid of them".

There are always stories in the news about overbearing and petty HOAs. Well, there are a lot of HOAs, some are bound to be run by overbearing and petty people, just as in any particular governing authority.

What are the consequences of ignoring the fine? They can't very well take you to court, can they? Will the HOA really go so far as to put you in prison for refusing to pay a $100 fine?

If I could buy a new house in a neighborhood without an HOA I would, but it Georgia the are mandatory.

Pink houses? Don't care. I bought mine when it was canary yellow and the one next to it was pink with green shutters.

18-wheelers parked in the street? Not in residential neighborhoods they don't.

200 cats? How would they know before it was too late?

And generally I don't see them go after the real problems. Have your grass 1/2" too tall - get a letter. Have a neighbor leave the windows open 24x7 (with rain getting in) no problem. Have a neighbor dump the oil out of the car and let it run down the driveway/street? No problem.

Bayshore Condominium Association President Tom Durkin said in order to conduct business, at least half of the 147 condominium association members must attend the annual board meeting, Saturday, Aug. 23.

The July 29 letter states, "Please be aware that the board passed an official resolution. If you are unable to attend the meeting and do not return your proxy/ballot, you will be assessed a fine of $100."

Attend one meeting, vote down all the proposals, fire Tom Durkin and all of his associates and supporters, save $100...that's a pretty good evening's entertainment.

hershmire 2008-08-23 07:13:18 PM
Hah, I just answered my own question with Wikipedia (new window):
In some U.S. states, including California and Texas, a homeowners association can foreclose a member's house without any judicial procedure in order to collect special assessments, fees and fines. Other states, like Florida, require a judicial hearing. Foreclosure without a judicial hearing can occur when a power of sale clause exists in a mortgage or deed of trust.

Why the hell would anyone give this kind of power to a "private government" with no judicial oversight?

dj4aces [TotalFark] 2008-08-23 07:14:14 PM
moops: Say all the bad things you want about HOAs, but you'll sing a different tune when you get a neighbor who keeps 200 cats, parks an 18-wheeler on the streets, or decides to paint his house pink.

fark you. People took care of these sorts of problems themselves long before there was such a thing as homeowners associations.

HOAs are part of the problem, not part of the solution. If there's a problem, there's an easy resolution that you could take yourselves if your nuts dropped a quarter of an inch and you manned up and confronted the problem. If you get an asshole, call the city or county on them. Code enforcement takes care of most of these problems, anyway.

There's a process you can follow instead of "paying dues" to some shifty group of powermongers who are too inept to run for political office, yet people like you happily embrace as the second coming of Jeebus.

/My lawn. Mow it, then get the hell off of it.
