Apparently he didn't disguise himself and was caught on surveillance video. Since the guy used to work there, one would think he'd remember the camera placement.

Sounds like an episode of Aqua Teen.

Obviously subby has no experience with the legal system, or they would know you can make anything go away by throwing money and lawyers at it. Pleading not guilty is just step 1. Step 2 is blame someone else.

I was thinking step 2 was "park the forklift in some other guys driveway"

You probably don't profit from it, but at least you get the satisfaction of sending an innocent person to jail.

Doesn't a guilty plea also destroy any chance of getting your sentence reduced later on? I remember wondering why my former roommate entered a not guilty plea even though they had a mountain of evidence against him (the Judge was "being a dick" by threatening him with 200 years, he got 80, he could've gotten well over 20,000 years), and that's what someone told me.

You do have to have some kind of rational explanation as to why there is a stolen forklift and ATM in your driveway, however. You can't just go to court, plead "not guilty" and expect the judge to let it go at that.

"Well, why is the missing ATM in your garage?"
"I don't know, but I'm not guilty."
"Did someone else have access to your garage?"
"No."
"How did it get there then?"
"I don't know. Maybe space aliens put it there."
BANG. "Give this guy 80 years!"

I live in Texas and ever since that stupid scene from Clerks 2 or whatever, any time I see a Texas A&M medallion on a car I think: "Ass to Mouth. That's gross."

Maybe they shouldn't insist on writing it as ATM

Pleading not guilty is standard legal procedure.

We have a system where saying, under oath, that you are not guilty when you are clearly guilty is accepted as the norm.

cepson 2008-08-17 06:30:01 AM
I don't know how they do it in Wisconsin, but it's not unusual for someone to plead not guilty at their arraignment, even when they intend to plead guilty eventually. In fact, there are circumstances where a defendant has no choice but to plead not guilty -- if he pleads guilty, the judge will enter a not guilty plea on his behalf. Without going into too many details, the arraignment is where the court advises the defendant of the charges she faces and the penalties associated with those charges. Court rules sometimes guarantee a defendant a certain amount of time to prepare for trial following indictment, but the arraignment comes very soon after indictment. Thus, the defendant is advised of the charges, pleads not guilty, and the case is set for trial. In the vast majority of cases, the defendant pleads guilty before trial.

Finally, pleading not guilty is not a denial of guilt, though it may appear to be so. Rather, pleading not guilty simply puts the government to its proof. Every one of us has the right under the Fifth Amendment of the Constitution not to give testimony against ourselves. If a guilty defendant was required to answer honestly the question, "How do you plead", the proceeding would violate that right. Instead, a not guilty plea just informs the court and the government that the defendant either chooses to make the government prove its case (no matter how easy that might be) or sets the trial date off, so that the parties can try to negotiate a plea agreement.
