It isn't. If you RTFA, though, he also supposedly threatened his "female companion", which the cops tend to take a bit more seriously than the bird. That's what earned him his trip to the back seat of the squad car, where he freaked out until they got him out to cuff 'im and he grabbed the officer's package.

While I don't agree with it, some areas have "Road Rage" laws that prohibit giving people the finger. In the case of TFA, they filed it under 'disorderly conduct'. Either way, it would have been nice if the guy would have gone to court and challenged the legitimacy of the law, rather than digging himself into a deeper hole.

Would have also been nice if he hadn't threatened someone's girlfriend... All the angst about "free speech" is misplaced as the guy did other things (which ARE against the law) besides flipping people off, so it's hard to really say precisely why he was arrested, much less say that he was arrested for flipping people off.

If he were, I'd be good and righteously pissed off like everybody else... but it sounds like he went beyond the bounds of free speech.

You're not allowed to threaten people. You can voice your displeasure with them. You can share your opinion far and wide and shout it from the highest mountaintops, but you can't attempt to intimidate them or make them fearful for their safety.

Disorderly Conduct is the catch all of police bullshiat. If they can't think of any law you may actually have broken, they charge you with Disorderly Conduct. It's the going too fast for conditions for more stationary police.

"Improper hand signals"

Law in most states, that you dont give the wrong hand signals while in a car. Yes, you can get pulled over for it. But only if you are the driver. So if you drive a motorized vehicle, dont flip off a cop.
