The SCOTUS has upheld property forfeiture laws relating to illegal activity.

These are the laws you asked to be passed, if not directly, then indirectly by allowing the politicians that enacted them to take office.

Actually, the DA is just being an ass. There is no requirement that he seek forfeiture of the farm. He can prosecute the case for possession only. *He* may have a policy not to do that, but there is nothing in the law that requires him not to use discretion. So let's be clear: he feels it's important to implement *his* vision of the law equally.

If the report is right, the guy had enough pot that the DA couldn't look the other way. But taking the farm, that is just being a dickhead and he knows it.

/If he's such a scion to the community, let's see if the jury nullifies it.

A pound per plant? I've never seen anyone get a pound of bud off a plant. Even if you threw in the leaves, it still wouldn't come near a pound per plant. Farking stupid cops.

This guy was a pillar in the community, he lived in a rural area with his dogs and never hurt anyone in his life. Now he's going to be busted as a drug dealer just because he grew some on his property. To top it off, they are going to take his property.

This war on pot bullshiat needs to stop.

I wonder how many people would support recall petitions against offensive public officials that do things like this?

If a community wants to honor and protect its citizens, it has to put its foot down occasionally and "just say no!"

If he is taken to trial, train citizens about jury nullification.

If they try to seize his lands, then take up a collection to buy them back at auction, with intent to return them to him.

But most of all, put pressure on elected officials to cut it out, or lose their jobs.

Representative Republic: Everybody arguing and trying to usurp authority and perpetual gridlock so that the basic foundation which is great never actually gets changed.

If we had kept to that we wouldn't have a drug war sucking billions of dollar a year while being a complete failure and basically a gigantic excuse to piss on the Constitution.

That might get the guy out of a jail term, but property seizure isn't subjected to jury trial (as far as I know). Basically, the DA files the right papers, says the right things to the right court and then they take your property away from you. In some places, the seizure laws don't even require criminal conviction - they cops just have to say that they MIGHT BELIEVE that the property was involved in 'illegal drug use' and that fits the requirements of the legislation.

And no, I am not joking. Nor am I exaggerating. The property seizure laws in this country are grossly unfair and easily abused. But because they only happen to 'the bad people' society dosen't complain.

we really are just one bad traffic stop or misunderstood conversation away from losing our house or car to an overzealous cop or DA.
