No, they foreclosed because he's an ass who chose to not pay his parking violation for years and then tried to use his mental incapacity and physical anguish, neither of which was apparently significant enough to prevent him from driving and living his day-to-day life in the interim, as an excuse.

The original parking fine was for a vehicle PARKED IN HIS OWN DRIVEWAY.

The "city" can suck eggs.

A parking ticket leads to house foreclosure. Huh. And the house was fully paid off. $50. What was happening at the time for him, I can understand that he was overwhelmed. A parking ticket is nothing to even think about when one of his parents died. If it was me, I would have forgotten about the parking ticket, because it really is insignificant.

I hate how the world has become. Everything is regulated too much. I want my own planet so I can live happily without having to worry about a tax on breathing or a fee for brushing my hair, which I'm sure we'll have sooner or later.

"Month after month the city Department of Neighborhood Services sent an inspector to the house to see if the van had moved or had license plates. Each time a new fee was assessed. And a letter was sent to Tubic's home."

I was thinking that if it was such a problem for the city (and whichever neighbor made a complaint about it), couldn't the city just have towed it, then charged him for the fees to that point, plus storage. Then let the Towing company sell the van if he didn't claim it?

"While Tubic paid the property taxes, he never paid the $1,475 for the zoning violation. With interest and penalties, he owed $2,645 before the city foreclosed on Monday."

On the other hand, the guy was acting like a jerk. Why he couldn't just pay the ticket and move the van, I dunno.

i have to confess ignorance about how this is supposed to work. so he owes the city something like $3000, and they foreclose on his house? exactly how does that work? how can they foreclose on a house that is worth way more than $3000? do they get to keep the extra money from the sale of the house?

step 1: write parking ticket
step 2: add ridiculous late charges when it isn't paid
step 3: foreclose on $275,000 home to pay $3000 fine
step 4: profit

Wow. Everyone involved is a loser. The dude for not paying the fine. The brother is the biggest loser for starting the whole mess. The city, etc.

Downer 2008-08-03 11:29:57 AM
So, how is taking a $245,000 home that is fully paid off justifiable compensation for a $2,600 fine?

And how is $2,550 a justifiable increase on a $50 fine?

I hate this world.

I just bought my first house last year, and my real estate agent never really understood why I would want to live outside of a neighborhood with HOAs and farked up zoning laws. This is a sad example of the kind of bullshiat that simply should not happen. There should be no way for a 50 dollar ticket to leave a person homeless. Period. I don't care if he didn't ever pay the fine.

They are taking the home of a feeble old man, a paid off home even, to cover a $50 zoning violation of having a vehicle with no plate parked in the driveway. How could anyone justify this and sleep at night?

"At this point," Schaewe said. "There's really not too much that would allow us to reverse those charges."

Oh... I see. Fannie May and Freddie Mac screw-up big-time, they get a $25 Billion tax-payer sponsored bail-out.

Ordinary citizen dealing with lots of tough life-issues - gets issued mounting fees for a vehicle parked in his own private driveway --- just because the state wants money. Suck-it citizen, we're taking your house so we can collect that 2,500 bucks.

/ this society is getting more and more farked by the day

The friggin lengths a city will go to enforce zoning has apparently been moved out like a country mile.
Any judge who sees a foreclosure sale over a lien on property as the correct course of action here really shouldn't allowed on the bench.

Puke 2008-08-03 11:32:19 AM
Just because they call themselves "government" does not mean they aren't a bunch of evil and violent thieves praying on the innocent.

It's people like the Boobieser that help perpetuate such violence and suffering.

The Dec. of Independence states that gov't is to protect "life, liberty and the pursuit of happiness."
How does a $50 fine (Demand by strangers upon threat of violence.) turn into stealing a man's home? Who did he harm? Who did he defraud? No one! All he did was ignore the immoral demands of thieves.

Government = Violence

I wonder how he is paying his property taxes. If nothing else, he could do a reverse mortgage to at least get his equity out of his house and to pay the parking ticket fine.

Normal procedure is that they confiscate your property, sell it at auction, they get funds up to the amount of the bill, any extra goes to you, and if it sells for less than the fine they take the loss and consider the matter closed.

Downer: So, how is taking a $245,000 home that is fully paid off justifiable compensation for a $2,600 fine?

Sounds like you are assuming the city took a $245,000 item that belonged to the guy and is going to sell it and keep $245,000. The article conveniently doesn't say, but if the guy does fully own the house, the government is probably going to auction the house and keep the $2600 and give the guy the difference.

And how is $2,550 a justifiable increase on a $50 fine?

It's called interest and penalties. You will generally find that if you don't pay your debt for 4 years, the debt will drastically increase. That's life.

Few people are against the government when it serves its (limited) purpose. This is not an example of good government.

By making him homeless, far more taxpayer dollars will spent on taking care of him via welfare than the original $50 fine...but whatever. Collectively we are getting dumber as the years go by.

ILoveTinyPuppies 2008-08-03 11:51:02 AM
"His father was suffering from dementia. His mother was battling cancer, and he was their live-in caretaker. He needed to shop, cook, clean, maintain the house and tend to his parents' needs.

The van repair could wait, he thought.

Then a man from the city showed up and told him otherwise. It was February 2004. Tubic would have to move the van or get license plates for it within 30 days, per city zoning codes, the man said. Somebody had complained.

Several days later Tubic's dad died. Tubic was overwhelmed, he said.

"It was a combination of things financial and emotional, my caregiving role, all heaped themselves on me at the wrong time," he said. "I still don't function well."

The guy didn't think it mattered, and ignored the notices he received in the mail, including foreclosure notices because in his limited mental capacity he thought if he ignored it, it just might go away. So, it turned into a situation that Milwaukee has never found itself in, foreclosing on someone's house due to city fines and taxes. And of course it just had to be a disabled man caring for his parents. It's sad that the fine was for parking his disabled van in the street without plates. It's dumb that it went ignored and that no one made him do it. It's funny that in the 4 years that he never paid, that he never ended up getting plates either as shown in the pic. If he wasn't disabled, he'd be just another deadbeat.

I'm just glad my hometown isn't in the news because he had 34 dead bodies of old ladies in the basement that he was making snacks out of.

He probably gets just enough from Social Security, and maybe his family, to pay the bills. Probably not enough to garnish, and they probably can't garnish disability benefits and unemployment benefits anyways.

COOTYSRATSEMEN 2008-08-03 11:54:42 AM
Even if you are handicapped and/or mentally disabled, if you have broken the law, you have earned the risk to lose your home, your possessions, and your freedom.

The government needs to do take every measure possible to ensure that people obey the rules and laws necessary to ensure that citizens are kept in line. If you so much as cross the street the wrong way, you have committed a crime, and should be punished to the maximum extent the law allows.

This country was founded neither on compassion nor charity, and damn if it needs to start acting in that manner now.

I doubt he will be homeless.
If he ends up homeless, it is not the fault of the government.

Kniggit 2008-08-03 11:56:28 AM
There is absolutely no excuse for the city to have given the fine in the first place. If the intent of the law, as admitted by the city official, is to keep homes from looking like junkyards, then the home must look like a junkyard because of that vehicle in order for the law to apply!

There is also absolutely no excuse for the city to impose ridiculous increases in the fine. It's funny that, being a civil court, the aggrieved party is supposed to mitigate its damages. The city government clearly didn't do this.

Finally, there's absolutely no excuse to collect it in such a heavy-handed fashion by foreclosing on his home. The more intelligent thing they could have done after getting a judgment is to get a court order to seize personal property or simply levy the tax increase. All that would've happened is the county sheriff would have gone in there and take $2600 worth of personal property and have been done with it. In fact, this is the perfect type of case for a constitutional lawyer to challenge in a real court whether the Eighth Amendment barring cruel and unusual punishment applies to state/local governments and not just the federal government.

Finally, this is all assuming that this man is mentally competent which the court didn't establish.

And for all you trolls who are rooting for the government or against this guy, wait until they come for your personal property on a whim when you have truly done nothing wrong or when they claim they properly served you personally when they really didn't. Take a stand now, or be subject to the whim of a bunch of leeches in official capacities with too much power and time on their hands.
