It is, but a statute banning "gang membership" could be overly broad and criminalize association with a group that may not in fact be engaging in overt criminal activity. Pure association is not illegal. Acting in furtherance of criminal activity is. For example, is a lawyer who represents a mafioso part of the mob, and therefore liable under RICO? This gets into a grey area, and one that should be avoided.

They could probably be hit under the federal money laundering statute, and if the money is transferred electronically, you'd have federal wire fraud charges. But then, that gets you under the jurisdiction of the feds, not the local D.A., which makes for less gripping drama.

Yeah, Khalid Sheik Mohammed and his friends ( who not only NOT American citizens but wish to KILL American citizens ) should have " due process " under American Law. I suppose you would have offered that to Hitler as well? Look up the story about how America delt with Nazi terrorists who came to the US to blow up buildings in New York and Miami.....no US court trials, no so-called due process, they were military tribunals....They were convicted and they were executed.

Period, done......

You know, I wouldn't care so much about terrorists killing Americans if I could be certain that the only people who were murdered were people who defend them and wish to provide them " rights " as if they were American citizens.
