It is, but a statute banning "gang membership" could be overly broad and criminalize association with a group that may not in fact be engaging in overt criminal activity. Pure association is not illegal. Acting in furtherance of criminal activity is. For example, is a lawyer who represents a mafioso part of the mob, and therefore liable under RICO? This gets into a grey area, and one that should be avoided.

I cant see how it could be a constitutional problem if the group they are a member of is a criminal organization. Hell i know that Texas and California already have laws that affect members of "criminal street gangs."

Yeah, Khalid Sheik Mohammed and his friends ( who not only NOT American citizens but wish to KILL American citizens ) should have " due process " under American Law. Look up the story about how America delt with Nazi terrorists who came to the US to blow up buildings in New York and Miami.....no US court trials, no so-called due process, they were military tribunals....They were convicted and they were executed.
