The decision makes sense to me. You arrange to bring someone into the country illegally, you're smuggling humans. The fact that the person being smuggled is yourself is irrelevant.

The suicide and masturbation examples make no sense--nobody is saying those who are smuggled didn't consent to being smuggled. The act of smuggling is illegal regardless of consent. If they didn't consent to being smuggled the charge should be kidnapping.

"Smuggling of human beings" means the transportation or procurement of transportation by a person or an entity that knows or has reason to know that the person or persons transported or to be transported are not United States citizens, permanent resident aliens or persons otherwise lawfully in this state.

From a legal standpoint, this is pretty cut-and-dried. Morally... I dunno, defining human smuggling as just moving illegal immigrants regardless of any other circumstances seems wrong. It seems like the equivalent of extending the definition of rape to cover sexual innuendo and harassment.

While in general, you're right (I was mostly being flippant), the fact is that they aren't guilty of smuggling, they are guilty of entering the country illegally. The person who is facilitating their entry is guilty of smuggling.

This is simply an 'add on' law, the same type of law that 'sodomy' is. Few states really care if you plant your flag in someone elses butt, but they keep it on the books to add on to rape charges.

A better example would be the way soliciting a prostitute is a crime. These immigrants aren't being abducted and dragged into the United States against their will. They're paying a lot of money to be transported here illegally.

I'm not really opposed to an open-borders policy in the U.S., but from a purely logical point of view, you can't make a "service" illegal and then not prosecute the people who buy and create a market for that service.
