Sexual selection and gender identity are either genetic predispositions, in which case your argument is false, or else they are not, in which case your argument is baseless. In either instance, genetic sex is still not gender identity because that is defined by the society.

Generally speaking though, its rare for transmarriages to be approved without the trans person first having either an orchiechtomy or sexual reassignment surgery. What really seems to get people is when say a woman and a MtF transpersion who is still considered male legally get married, and the the transperson gets srs and is legally consiodered female. Essentially as the law sees it, they started out as a straight married couple, and are not a lesbian legally married couple.

Question: Since there's SUPPOSED to be a separation of church and state, why are marriages even recognized under law? Basically, the way I see it is if there was a true separation of church and state anyone regardless of sex could get what would be officially a civil union entitling the couple to all the benefits and legal standings of under law now is referred to as marriage, while those that undergo churchly proceedings would be considered married in their own faith communities, thus leaving the issue as to whether they are "married" up to the church. "Marriage" in its current definition under the law is just another way that religion is being forced upon the public in what is supposed to be a faith-independent society.
