Correct, it should be off when installed, but I think it would be a lot of trouble if technicians decided to start installing harddrives and making people pay for it without first checking to make sure that the harddrive was installed correctly and that information can be accessed and retrieved without problems first.

Okay, I'm not defending this dumbass but we don't really know what sort of "child pornography" was on his computer. It could have been simply a picture of a naked boy which, while a bit creepy, doesn't mean the guy was a rapist. Maybe he just likes jerking it to pictures of naked boys in which case it is thought crime.

Obviously, the law is broad enough to include almost any image of a child, clothed or not, as "child pornography" depending on the intention of the possessor. If the FBI finds pictures of the little neighbor girl in her bathing suit on some guy's hard drive, taken with the full knowledge and approval of her parents, and the FBI decides they think he's a perve, then off to court he goes and his life is effectively ruined even if he's tried and acquitted.

/not saying I have any pictures of the neighbor girl or anything

"new hard drive installed" could have meant they were adding a second one, in which case any responsible technician would want to get into windows and make sure the drive was recognized and accessible.

Or if they were replacing the one he already had, they could have needed to get on and backup his data. Sure, in a lot of cases that could be done by just dumping the whole drive, but if he used windows' built in file system encryption (and they were putting a fresh windows install on the new drive) they would have to decrypt the files before transferring. Of course there's really not much point in encrypting your drive if you intend to (1) give out the password or (2) leave kiddie porn readily displayed on the desktop.

How freaking hard is it to just replace your laptop HD? I mean, it's even easier than a desktop thanks to the HD caddy: just remove the external plastic cover, pull out the old HD, put in the new one, put the cover back on, and reinstall the OS using the restore disk. I buy broken Toshiba laptops on eBay, swap out the parts and re-sell them in running condition - this guy has to be a dumb-a$$ not to know how to work on his computer.

Still, I'm glad the (alleged) kiddie raper got caught. He's old, stupid and slow, he'll be dealt with fast in the Pen.

It's not (in a perfect world) the masturbation to child porn, or the wanting a naked child that is illegal. It is the support of pictures of children forced (at that age you can't legally say you are cool) to be photographed naked.

Masturbate to anime child porn all you want. I don't think rational people have a legal problem with that. But when you support sites that make a living off of abusing children that is as Sonic would say NO GOOD

It could be argued that even posing nude does psychological damage to a kid.

As for the pictures of the neighbor's daughter... Unfortunately, our only viable options when defining something as pornographic are "I know it when I see it" or "nothing is pornographic". Would be nice if we had some objective definition, but we don't. I think Japan is responsible for that.

Not to defend any person with CP on their machine, but a VP at my company brought his PC in to CompUSA to get it worked on (yeah, i told him not to do that again).

His wallpaper was a pic of his 1 year old son, nekkid, standing in front of the bathtub with his back to the camera. The shiatheads at CompUSA tried to scare him by telling him it was child porn.

I'm hoping the guy in the TFA didn't get busted for something similar.

/CompUSA techs picked the wrong guy to try to scare. He uncorked on 'em and was yelling "YOU WANNA CALL THE COPS? TELL YOU WHAT, HERE'S MY F*CKING PHONE! WANT ME TO DIAL 911 FOR YOU? I F*CKING DARE YOU.
