Nicola has filed a lawsuit against the National Audubon Society, which owns the sanctuary, saying it didn't keep the boardwalk clean or warn the public about a slippery surface. The lawsuit seeks compensation for her injuries.

Doesn't seem frivolous.

Especially since most people are looking up at the birds and not down at their feet.

It's a bird sanctuary with a wooden board walk over a wetland. Common sense should prevail; you shouldn't need to be told it might be slippery.

If she was a long time Bon Jovi fan this would never have happened.

Goopotato 2008-06-15 04:10:47 PM
If she had sued because she slipped on bird crap out in public, this would definitely be a retarded lawsuit.

Instead, she's suing the people who are probably liable for the injury, so the only retarded thing here is subby.

I bet they didn't specifically warn her that the ground was hard, either. Maybe she should double down on the lawsuit.

Bullshiat. Have you ever been to an Audubon Sanctuary? It is woods with trails. You don't look up at birds without paying attention to where you are going unless you are standing in a bird blind. It isn't a farking movie.

FARK is full of law students, subby. In law-law-land there is no personal responsibility, and the blame always goes to the biggest pocket, no matter how many degrees of separation it takes to get there.

Ugh, another idiot suing because she couldn't be bothered to watch where she was stepping. Bird shiat, ice in the middle of winter, pebbles...all the people suing because they couldn't be bothered to watch where they step should be shot and converted to biofuel so they can serve some kind of purpose.

She should sue gravity for being so attractive.
She should sue her legs for being attached to a dumbass.
She should sue her own body for being so fragile.
She should sue matter for not having the density of marshmallows.

This is one of those politically divisive stories. On the one hand she is nanny suing because she wont take responsibility for her own actions. Om the other hand she is suing a hippie borne ecology driven entity.

My kid was running on a boardwalk once and fell, breaking a bone in her arm. I was carting her away when someone came up and said "I'd sue if I were you!". I asked why..."because they didn't protect her from falling". *sigh* The kid started to run, I said no running, walk, it's slippery. She walked...then took off and fell. No need to sue because she didn't listen. Like I told her...shiny surfaces can make you slip, don't run on them. She learned her lesson, life goes on.

Suing? Give me a f'ing break. Take some personal responsibility, people.

Yes, yes you can, and FARK has a lot of lawyers that would help you to do so.

I've been to this place a bunch of times on school trips. She slipped on bird crap on an outdoor wooden boardwalk. It wasn't even slippery in December. Talk to me in August when its raining a few inches every afternoon. How is this anyone else's fault!?

Oh thats right. United States of Litigation.

It doesn't take that many degrees of separation, since the Audubon Society owns the park. The suit may or may not prevail, but if you own a park or a store and let the public in, you have to take reasonable measures to keep it safe for guests. For the same reason that Kroger has to put up a wet floor sign after they mop.

FARK is also full of radical "responsibility" fetishists who would argue if someone sued after getting shot that the dumbass victim should have gotten out of the way.
