If the President gives out pre-conviction pardons it does not prevent testimony from being coerced from the people he pardoned. If he gives them clemency after the conviction they can still claim 5th amendment protections against self-incrimination.

Cite? I'm not saying you're wrong; I'm just saying that (a) I've never heard of this, and (b) it doesn't make any sense to me considering that the Fifth Amendment privilege, to my knowledge, only applies when actual legal jeopardy is in play. Wouldn't the double jeopardy provision prevent any subsequent prosecution?

I'm not sure exactly what you mean by "excusals," but if what you're suggesting would in any way impinge on the President's constitutional authority to issue pardons, it could not be accomplished by mere legislation - an amendment would be required.

there are avenues congress can take that don't fall under the authority to pardon, like civil proceedings. i'm just kinda guessing, but i'd think that if it doesn't involve the DoJ and only involves congressional trial, it might fall under that category.

but i could very easily be wrong.

The Constitution does not explicitly state whether the President can rescind a pardon which has been granted, either by himself or by a predecessor, and as far as I know no President has ever tried.

By tradition, the courts have treated the acceptance of a presidential pardon as roughly equivalent to a guilty plea and a suspended sentence. I wonder if calling "do-over" would constitute double jeopardy, or if the processings would simply pick back up at the sentencing phase where criminal charges had been filed.

I'm actually glad this was held off so long...I want any resolution to come AFTER Bush is out of office. A lame-duck Bush would just wave his magic pardon wand, Obama certainly would not and McCain would be at least very reluctant to open his term by pardoning an unpopular political criminal strongly associated with the highly unpopular previous president.

The question is, will Congress have the balls to have him dragged in after he asserts the phony "uber-Executive Privilege"?

Bush didn't pardon Libby. He 'commuted his sentence'; served no jail time but had to pay a hefty fine...which he could easily do thanks to all the money he saved up embezzling from Enron.

And if the case extends past Jan. (what day is it again, that the new prez takes over? the 4th or the 6th or the 20th) (which should be how the DOJ handles it, Rove might be the fall guy. Which is better than nothing. Swear to god tho it would be FANTASTIC if they treated these war criminals the same way they treat regular criminals: offer a lighter sentence if they fess up to others' involvements in crimes. You know, like how that girl who got caught with a bit of weed was used as an undercover informant in a sting and ended up dead. Check normal, it's been almost 2 weeks since it happened and I know for a fact they have it on the front page, just not the top story.

What are the odds on Rove pulling a Bud Dwyer? (no, not budweiser! Bud Dwyer!)

he can pardon someone after they've been convicted, but as far as I know, he can't like, decide to overrule the 3 branches of gubment and cancel a trial.

And that's the point of my last post, if the trial lasts longer than Bushs remaining days (oh it's Jan 20th I remember now) and he/they don't stage another false flag to declare martial law and suspend elections and outlaw buying guns, they might just leave him out to dry.

Or they could assassinate him before he testifies, to protect themselves.
