Once they're subpoena'd and entered into evidence, they're public property.
This is part of a felony case. All evidence is normally made public.

zymosan: How did these get released? state paid for phone or something?

they were using city issued pagers. the text messages were discovered as part of some police officers investigations. they were later fired and filed a whistleblower suit against the city and KK. The city council rubberstamped agreed to pay the lawsuit, in fact they paid 2 million more than what the settlement agreed to. That's because the officers (through lawyers) threatened KK with the release the texts. The news paper wondered why the city council paid more than the agreed upon settlement amount and did some digging. They found out about the text messages.

Was it city council or the media? I thought the News (or the Freep) started digging and city council thought that maybe they should to. Can't remember though. Not that it matters, as long as KK goes away.

This case will make a lot of people sweat.

The records were subpoena'd. Your spouse can't just call Sprint and ask for the records. This guy sounds like a steaming pile, but there are a whole lot of people in the world who wouldn't want made public pages and pages of inane "i heart u, lol" texts.

FTA: Kilpatrick said Tuesday evening that he questioned the authenticity of the messages and that their release did not provide "the smoking gun" many had expected.

It's not as simple as "they subpoenaed them"

Here's a link to a article that explains how they got them. It's pretty wild. A lawyer in a civil trial got his hands on them. As part of the settlement he agreed to not disclose them. And in fact deleted them off his computer. But...
FTLA: A computer forensics expert hired by the City Council extracted the document from Stefani's computer.

Stefani had testified in a deposition he destroyed his copies of the motion and deleted it from his computer to comply with a secret side deal he struck with Kilpatrick and Beatty to keep the text messages under wrap as part of the $8.4 million lawsuit settlement.

Goodman said the document was found after a computer expert went over Stefani's computer. He notified the court of its existence on Monday afternoon.

The people of Detroit are the ones who need to be punished here, my favorite idiocy out of them was when it became obvious that public funds were being used to pay for her luxury SUV, something to the extent that they wouldn't begrudge him the honor of giving his mistress a proper ride.

Typical Detroit resident:

"I love the hip-hop mayor. I'll contribute money to his legal defense fund (which means to his $700/hour criminal defense attorneys), because these charges are just haterz out to get him. Nevermind that the schools in Detroit are garbage, I can't afford to make rent payments or insure my car, and city services are dismal at best. I need to get the money to more important things - defending the hip hop mayor, who has been bleeding the city's budget dry over the last 6 years with cars for his wife and overtime for his 25 person "executive protection unit"(i.e. the mayor's thug buddies who need jobs)."

I understand that he is the second highest-paid mayor in the country. Good to see that running the business of one of the most decayed, mismanaged cities in the western hemisphere leaves him with all this extra time on his hands. Thank goodness for knowledgeable voters!

See Washington D.C. for more of the same. Mayor Marion "Crackhead" Barry keeps getting re-elected to the city council.

Drakuun 2008-05-01 10:25:36 AM
BTW, for everyone that doesn't know, the Detroit City Council is who runs Detroit, and they are the biggest bunch of racist, biggoted crooks in the city. Kwame is just their mouth piece. It took them about a year to finally denounce him publicly over this, and only after he was in so deep that they could 'cut him loose' without it reflecting back on them. Kwame is a symptom of the problems in Detroit, not their cause.

Not around here, it ain't.

Thing about this I don't understand: Stefani (cop's att'y in the whistle-blower suit) had the messages & knew he could prove that KK was lying under oath. Does he bring that to the judge? No, he keeps them secret, and then threatens the mayor with making them public unless they pay him an additional $1M in fees, above what was requested in the settlement.

Seriously, how is this not blackmail? If I'd tried the same thing, I'd be in federal prison by now. They talk about him like a hero around here, when he was really just skimming an extra $1M off the city. He's as much of a crook as Kwame; even more pathetic since he was just doing it for the cash.

UAW and Teamsters did their fair share to drive the manufacturing base away from the city, further contributing to its economic decline.

They were released to the newspapers based on a FOI request. However, the newspapers have to petition the court for a FOI request. The texts were released directly to the Detroit Free Press, not to the court. There is a question of how legal that act was.
It's unfortunate, as I'd like to see him nailed for all 8 felony counts. If they can get the texts thrown out, they'll likely only be able to get him for one felony.

After reading the rest of the comments, a clarification. The Detroit Free Press has had the text messages since they were (possibly illegally) given them by the pager company. The recent uproar has been brought up because of a motion (that was never filed) that was retreived off of the cops lawyer's computer. Because the cop's lawyer had the motion, it was considered in the public domain. Since it was now a matter of public record anyway, the Free Press then released the rest of the text messages that they'd had for months.
