It sounds like the documentary filmmakers didn't actually get permission from anyone to use the song. She might actually have a case here.

The documentary film deals with academic and scientific discrimination from Darwinists against intelligent designers.
Stating that as the track was played for commentary reasons only it should be allowed under the fair use policy.

In a statement they said "We are disappointed therefore that Yoko Ono and others have decided to challenge our free speech right to comment on the song 'Imagine' in our documentary film."

This documentary has been caught in several complete, bald-faced lies already. It's rather amusing that a documentary by "Christians" seems to be so sleazy.

They seemed to have used it for commentary purposes ie, most likely saying the lyrics are total shiate.

It kinda depends on how long the usage is. If it's only a few seconds, I believe they will be able to claim fair use.

Considering how incredibly dishonest the makers of this "documentary" have been about pretty much everything else, I actually have to side with Yoko on this one.

The article that should be linked is here (^). My read is that the case isn't so much about the footage of John smoking weed as it is about owning the rights to John's image and to the footage. These guys are taking that footage of Lennon that John and Yoko shot and making their own movie out of it. Yoko's claiming that she has the rights to it and that these guys shouldn't be able to capitalize on it. I can't say I disagree with her on those grounds, although I suspect the idea that people seeing John behaving in a less than socially desirable manner (put as much of that in quotes as you like) would curtail revenues, particularly from middle America, probably comes into play, too.

Personally, I'm pretty annoyed that the use of recreational drugs gets so heavily glossed over in so many recent documentaries on '60s icons - The Beatles Anthology and Scorsese's Dylan documentary, No Direction Home come immediately to mind. Ultimately, it's their footage and they can do what they want with it, but it still paints an incomplete picture.

I think, after careful thought, that they would have made one, maybe two more albums after Abbey Road. They would have called it quits anyhow. Bands break up all the time. They had grown up and matured and were no longer who they were when the band was formed. BUT, Yoko was the catalyst that sped up the process. They might have come back in the late 90s when George got cancer to get some more licks in before the big sleep.

The few good songs Ringo and George did would have counterbalanced the increasingly pop Paul and the angst & LSD influenced dystonal weirdness of John. I did do an AfterBeatles custom mix CD of their good solo stuff, it's not bad.
