I kind of see the point. What if some gangbanger brought in a cane claiming an injury and started hitting people on the head with it? Still the reasonable thing to do is call the girl's emergency contact number and ask if she needs the crutches and then ask for a doctor's note the next day. With today's zero tolerance idiocy, I'm surprised she was not suspended.

This girl participated in basketball, track and soccer. I bet she was a good student. Without completely knowing the other side of the story, I am going to reasonably assume there was gross negligence here. This is a crime against an injured girl.

This is ridiculous. The nurse knew she was being taken to the hospital for a knee injury. When the girl went to school with crutches, the nurse told the mother they needed a note. The hospital tried to fax a note, that the school didn't get because the school's fax machine was broken. Nurse takes crutches away and does not give Amber access to the elevator, forcing her to walk up and down stairs. In pain she calls her mom to take her home.

Then it gets really crazy

"I got home, took her immobilizer off, and her kneecap was on the side of her leg," Elalem said.

Forget the lawsuit. If some stupid coont school nurse did that shiat to my kid I'd be seeking criminal charges against her, and would be making sure she lost her license to practice medicine.

Either that or I'd be having a conversation with some Italian gentlemen of my acquaintance to arrange for her kneecaps to have a close encounter with a baseball bat.

I broke my leg when I was 12. No one at school asked me for a doctor's note to use crutches.
Of course the cast up to my hip was a good indication that I had a legitimate need for crutches.

I tore the ligament in my ankle playing basketball for my high school. They GAVE me the crutches to use. Guess the physical therapist would be arrested for giving me a weapon nowadays.

I say kudos to the nurse and to the school for using the rule book instead of using their brains. Those crutches could have been used as a weapon or could be used to conceal drugs or terrorists.

Rules are rules and they should be obeyed.

Start with the DISD board here in Dallas...That place has been a crooked mess for decades and needs to be completely shut down. Shady contracts, excessive executive board member pay, etc..

Stuff like that drives me nuts. My seventh grader got in trouble for giving another student a "high five." It broke the "no touching" rule.

No, no, seriously, though, I know they're protecting themselves and the students from this girl suddenly getting on her two feet and swinging her crutches in a freely-flowing motion akin to T'ai Ch'i. But unless she's kunoichi, undercover mission, then guess what, SHE REALLY IS INJURED AND NEEDS CRUTCHES. Shouldn't that be evident enough?

She gets heat for this, meanwhile, there are boys in schools with overpowering BO (the kind of O that sticks around even after the B is gone) and they don't need a doctor's note for it?

When I was in jr high, some kids would come in crutches that were clearly not injured at all. If it ever happened that one kid came in crutches for a legitimate reason, a few other kids would bring their crutches from home and walk around. Not sure if it was hypochondria or for attention, but they were definitely not needing the crutches.

I'm not saying that's what happened here, but it's all I could think of when I read the article.

Most adults wouldn't stand for that- simply refusing to move if they knew the action would cause them physical damage as it did to this girl. (I'm sure there are a few that would try to macho through the pain knowing they're tearing the hell out of their leg in the process just to impress the ladies, but those aren't normal people.)

The only reason this girl kept walking on her leg till the pain was debilitating is because of threats from the adults. I fully support any additional punishment for that whole "abuse of of authority" thing to be introduced when they press charges. (Or whatever it is the keep charging teachers with for having sex with legal-aged students, or firing people in office relatonships.) The concept that you were intimidated into doing something you otherwise wouldn't due to the other person's position of power over you.

A single phone call could have solved this. Instead they injured a child in the name of some zero-tolerance power trip.

My nephew had two pencils pulled out of his backpack and seized by an airport screener for being "too sharp." He snapped off the tops of the pencils with his thumb and shoved them back in the bag.

His mother had a pen in her checkbook. It was allowed to pass.

Clearly the real threat are yellow #2. If terrurists can take over a plane with a pencil, they're too damned dangerous to be in a school, in the hands of children! Pens are OK, though.

Where was the Principal during all this? Should not the nurse tell him/her what was going on to get specific instructions when the school policy conflicted with an obvious need?

True story: I was in 10th grade. Had a bunch of the same friends in honors bio that all had honors french the next period (which I had NO business being in, but was let in just the same). Anyway, I'm sitting between two friends, guy and a girl (who would go on to tie for first in class), and I'm telling disgusting jokes to my female friend, trying to gross her out. I musta said the wrong joke, because the next thing I know she's swinging for the fences with her text book and lays me out. My nose is pouring blood, I can't see straight, there's blood everywhere everywhere. I walk to the nurse (other side of the building, so there's a trail of blood) and get patched up.

What happened to my friend? Nothing. Not even a detention. I understood from that point on that certain people (i.e. a straight A student who letters in 2 sports) can get away with things that the average guy would get suspended for.

Then again, this was before Columbine, when schools didn't push the panic button when someone brought a nail file to school.

Good times, good times.

Any of you farkwits who claim that say resisting arrest in a traffic stop warrants a tazing have no right to complain about students' crutches being confiscated.

Because both are excess uses of authority.

No school staff should be allowed to physically touch a student like that without vital reason. That includes wrestling crutches away from a girl.

And if there was a need to penalize, then you simply suspend assign in-school detention, and sort out the details later, just like if there was a need to penalize some citizen for resisting arrest, then simply add that to the list of charges to be levied against you in the courts.

I understand the policy is to prevent dumbasses from hitting each other, but this is still almost unfathomably stupid. As has been mentioned, kids can stab each other with pencils, beat each other with books... Hell, I remember threatening to hit a boy with a baseball bat during gym when he wouldn't stop making lewd comments when it was my turn at the plate. I could have done it before the teacher stopped me, and he's lucky I wasn't the least bit serious.

My point is, anything can be a weapon and it's better to let someone who was known to have an injury use crutches than take them away and cause what must have been agony.
