I don't dig Hilary. She's farking crazy.

But she was doing her farking job. Doesn't change the fact this could hurt her, but it's ridiculous to imply she should have torpedoed a client appointed to her.

Read the story. Page 3. This was from Hillary in seeking a psychiatric exam.

"I have been informed that the complainant is emotionally unstable with a tendency to seek out older men and to engage in fantasizing," wrote Rodham, without referring to the source of that allegation. "I have also been informed that she has in the past made false accusations about persons, claiming they had attacked her body."

Without a source for that allegation, there's a problem in saying that, even if you are the counsel for the defense.

She mounted an aggressive defense on behalf of her client. That's how our legal system works and attacking the credibility of the accuser is standard practice.

This isn't news. I'm no fan of Clinton- I really, really hope she doesn't get the Democratic nod- but this is just dirty pool.

BoneStorm 2008-02-24 05:28:53 PM
yeah, im going to assume that at least one person who reads this will probably wish they had such an aggressive defense counsel when they get busted.

defense is a tough job, but necessary.

I'm not voting for her, but just leave her alone. This is like 1st grade taunting, so elementary (school).

This.

Is it shiatty? Yes. But that's courtroom law. It's not like she invented it. She was doing her job.

Everyone is entitled to face their accuser and hire an advocate (lawyer) to present their case. Hillary's job, if not to get her client off exonerated, was to just show that there was some reasonable doubt.

Lawnchair 2008-02-24 05:52:24 PM
Again, it's all about the passive voice. "I have been informed..." was the quote. If there was an informant, she's doing her job. If "she was informed" by a little birdy on her shoulder, there's a big ol' problem here.

Edsel 2008-02-24 06:17:04 PM

Sorry, but while that may wash in terms of lawyer ethics, making shiat up about a 12 year old girl who's been raped is just downright sleazy.

Ah, Hillary invokes the Nuremberg Defense.

I don't care if she went after someone's character on the stand in a he-said she-said trial, but for someone claiming to advance women's rights and who worked for the Children's Defense Fund (that shows up prominently on her CV, despite working there less than a year)...

Twelve year old girls do not claim rape just for kicks, especially if there was forensic evidence. The "do whatever it takes, damn the consequences" approach Clinton uses is precisely the problem with her politics, and why there are several threads of videos showing her histrionically attacking Obama.

And why is it ok for her to question the character of a 12-year rape victim, but Newsday shouldn't question Hillary's character?

I'm not saying I support Hillary at all. I don't. I find her to be a cold, heartless biatch. Nor do I want a person who would do this as President. All I am saying is that it was her job, as slimy and shiatty as it was.

I agree it was a shiatty job, and not one I envy. But there are ways to go about doing things- get the guy off on a technicality if you're good enough. It's just that I've worked with child sexual abuse victims in the past, and tearing down the accuser in a case like this is beyond damaging, it compunds the original crime. If he was really innocent, she wouldn't have had to resort to this. Best defense != total offense, even in war.

Good for Hillary for being advanced and secure enough a female to acknowledge that fact of reality.

Nice. This election seems to be about optimism and change. It would advise against using sarcasm and cynicism. I've never done this in any thread, mostly because I liked the guy, but this is Hillary's "Howard Dean Moment".

That's how our system of law works, duh. If she didn't try her best, she'd be letting down the entire US Justice system!

This is not to say that I like Hillary, but this is just stupid posturing. There are plenty of real reasons to dislike her. Like her continued support of the Iraq screw-up.

How do you know she just made it up?

Look, there are many reasons to not support Hillary and this is one of them. But its not one of them because she did anything wrong. That hasn't been established. This is a reason because the right wing will make this one look like a swiftboating times eleventy.

She is a Lawyer. She was obligated to represent her client no matter what. This actually causes me to respect her a bit more. Sometimes we must engage in distasteful actions to preserve the justice system.

I feel so sorry for public attorneys who know their client is guilty, yet still have to defend them. I feel even sorrier for those who end up winning and know they let a predator back on the street.

That is their job and their burden.

While her tactics were slimy, it's the unfortunate nature of a defense lawyer's job to be slimy. And yet while it is the nature of the job, saying a 12-year-old made false rape accusations despite having injuries consistent with a rape and that the alleged victim wanted to get into sexual relationships with men who were the alleged rapist's age is not particularly noble.

Nobility has nothing to do with law. Attempting to do what's right as a lawyer is malpractice in many cases.
