Just once, I would like someone to offer up a reasonable answer (shiat - any answer) to this question:

Why is the existing FISA provision for retroactive warrants insufficient?

The right answer could sway me. But nothing that any of the warrantless wiretap supporters has offered thus far is compelling.

Bush won't answer that question because the answer is unacceptable. "Because we don't want any paper trail of our activities in this regard."

I'm not saying they should take it up. I'm pointing out that they are about to recess without voting on FISA (which just passed the senate), and which is about to EXPIRE on Saturday. That's THIS Saturday.

That being so, the FISA vote is FAR more important to the country's interests than this nonsense...

House Democratic majority leader Steny Hoyer asserted to reporters that even if the foreign intelligence surveillance law expires, Americans will not be in danger and the intelligence community will be able to continue intercepting communications of suspected terrorists.

Um, why are they passing a new law then? Will the Democrats pass the bill in the House without immunity? No. They'll roll over. Just like the DOJ won't prosecute based on this vote.

We've got to have FISA in some form. Not voting on it and letting it expire because they disagree with some elements of it, and having nothing in its place, is simply not a responsible course of action.

I see that point, but I hate for something so important to be dismissed as mere partisan bickering.

As for FISA, there are serious problems with it and they need to get it right before passing/renewing it. I don't like the idea of them being pressured into doing it with fearmongering tactics.

And as dumb as some of the congress critters are, I think they are capable of working on two things at once. Holding a vote on one thing does not mean ignoring everything else.
