"If a guy's got four DUIs, I'm more likely to take immediate action," Steinberg said. "If a guy's 40 years old, never had anything, has no juvenile record and works steady at his job, I'm probably going to proceed cautiously."

What the hell? Isn't that supposed to be sealed and never looked at again?

depends on the state, and sometimes local laws. although I have no idea how it would work moving from a state that acts as you say to one that keeps everything on record to use against you.

I had one of these when I was on house arrest. 120 days of 10-15 phone calls per day coming through the machine. It had an infrared camera to confirm your identity, and a breathalyzer to see if you'd been drinking. I don't remember how much they charged to me to "rent" it, though.

I don't know, having your rights taken away and your actions monitored by the court; without being convicted (or charged)of any crime is pretty scary.

I have one of these in my bedroom right now. It is for my second DUI in 5 years. Washington state is tough on DUIs. It is about 18 bucka a day to rent. It can't detect pot but I have to miss work and check in weekly to do a UA. I am not to use any cologne, body spray, eat anything that has vanilla extract in it or use mouthwash. It'll detect the alcohol and I'll be going to the pokey.

With any alcohol related offense in this state no drinking/doobing and going to treatment is a part of the sentence even before you are found guilty. I am on probation for five years. If I get in trouble for anything booze related I'll have to go before a judge for breaking my terms of probation.

/Along with the constant rain, unaffordable housing and all the fat snooty chicks this is yet another reason not to move to Seattle.

And the liberals are always crying about bush taking away your rights?? How long before they (Washington State) have a camera on every corner like the UK?

HMS_Blinkin 2008-02-10 10:05:51 AM
eqtworld: This is a great idea, we should put one in every house. No man or woman who drinks at home should ever be allowed to see his/her children.

They're not testing for whether or not people drink, they're testing for the frequency of drinking. If they call you every day at 10 am and you're always hammered at that time, then they can assume you are an alcoholic, but if you are only drunk when they call you on weekend evenings, that is far more normal drinking behavior.

Lehk 2008-02-10 10:15:17 AM
this seems to me like a way to protect your rights. now when your lying psychopath ex Wife tells the judge you are an abusive alcoholic and tries to take your kids away you can prove to the judge that she's a lying psycho and you aren't an alcoholic.

downtownkid 2008-02-10 10:25:29 AM

Because as a American citizen I should have to prove my innocence to the court at their every whim? And what are my protections from a malfunctioning machine? What about the day off of work I have to take every week so I can do a mandatory UA (like a previous poster had mentioned), now I have lost 1/5th of my income to pay bills and child support. I thought liberals liked people using drugs anyway?

Seems you didn't bother to RTFA:

"When these allegations are made...it's a lot of he-said, she-said. This is a way for a judge
to address the issue, but at the same time address the concerns a custodial parent may raise."

All it takes is a psycho ex-wife to accuse you of being a drunk parental tard and this gadget
(which you get to pay for...) could be installed in your home and if you happen to have a single
glass of wine with dinner while the kids are at your house for the weekend, you are screwed.

as it is now, there's a chance the judge will just go ahead and believe that you are an alcoholic so you lose the kids without any way to prove you aren't a danger.

compared with a sane family court system this would be worse.

I once was arrested for Public Intox. Signed a plea deal - a diversion - so that the case would be as if it didn't happen, etc. Anyway, so I go to sign it and it says "you can't go in bars or liquor stores or have any in your house." I was like WTF? I also said "fark that" and so right after signing the damn thing I went and bought a 12 pack and drank it right then and there. Then I went for the whiskey. Anyway, yeah, that's what I did.

What part of the quote I quoted has anything to do with child/spousal abuse?

Rodeodoc 2008-02-10 11:54:33 AM
FTA: Not every accusation, however, results in a person having to submit to random tests, Steinberg said.

It's only when the female of the species lies and biatches about the male of the species that they get used. Biatches can lie about anything in a custody case and get away with it. Men pay the price.

So for the judge, a female making an accusation means the male submits to random tests. A guy making the accusation means he'll be told to STFU or he'll go to jail.

Easier solution: Don't put your dick in crazy.

Also, did anyone see this:
FTA:After she failed a test last March, a Westborough District Court judge revoked bail for Alison Voorhis, who was accused of driving drunk when her car slammed head-on into a car driven by Evagelos Pashos, killing him.

Why would the judge be allowed to make decisions after failing a test?

When I was in the Navy, if they got a hardon for our drinking behavior, they just forced us to take Antabuse. People who really were alcoholics conditioned themselves slowly until they could drink enough to get a buzz without getting too ill. Now I guess that tactic's down the shiatter too.
