True enough. The nursing home may have cleanliness standards, though probably not for the residents per se. More likely for his room and/or clothing. You can't evict someone just because he stinks.

Seeing how he has open wound I wish the court would have said that he must bath so that he can be treated and when they clear up he has the option to return to his former state.

That way he can get treated, and if he can chose between bath/shower or sponge he might be able to get over whatever problem he has with water.
He could "just" have an extreme fear of drowning, and it might be that if they show him that at least the sponge bath will be ok, then he could take a step into doing it himself.
