Yeah, I dont think they actually escaped so I can see why he would plea not guilty

Well it is #2 (actually tied for #1) accoring to IMDB ratings (new window).

But if you haven't seen Escape from Alcatraz you should watch it. Shawshank was VERY similar.

I'm thinking the judge hasn't read the constitution and the part about excessive bail.

He's fully within his powers to deny bail but goes for the constitutional violation instead.

I thought of that as well.

Two things: First and foremost, how the hell can you plead "not guilty" to charges of having escaped prison. Can you prove that you were in your cell during the time?

Second, degrees of escape? Same thing... Either you're in your cell, or you're not. There's no state of nearly being in your cell.

Exactly. If you are outside of the prison area without a valid reason (work release) then you are guilty.... or so i thought.

More to the point, they are already in prison for another criminal act, why are they even being considered for bail? Send them right back to complete the existing sentence + some.

If he say, only had a few months left in his prison sentence, and that was done before his trial for the escape came up, the bail would be a matter of issue.
