A record label does not own the rights to live performances of their artists, unless they were responsible for the live recording.

That only applies to the Dead...so with 3/4 of the Beatles expired (George, John, Pauls face) I think they can release whatever they want.

There are lots of live Beatles available that aren't from labels. All the early shows sound mostly the same.
