I thought submitter must be mocking Wal-Mart, but that's exactly what the employee is reported to have said in TFA.

Google found a more detailed article on that obnoxious mainetoday web site that after loading the page replaces it with an error page if you are using Firefox and don't have javascript turned on. (My text browser loads the page just fine.) Quoting from said stupid web site:

In his complaint, Nolan said he thought it was a joke when he was asked on Dec. 8 to fill in as the store Santa Claus at the Wal-Mart on Main Street. He said his co-workers were laughing.

Nolan, who described himself as an atheist who does not believe in Christmas, said he laughed as well and then declined. "I said, 'Uh, no way,'" he said in an interview last month.

In conclusion, I think I hate everybody involved in this story.

Santa is hardly a Christian symbol. Just dress up, make kids happy, and have a good time. He should have said, "No, you don't give me good health insurance and kids are a major disease vector, so no."

But the rejection to do so, based on "religious" beliefs, should not be reason for dismissal. That's the issue here. If it was someone fired for believing in Jesus, or whatever other religious personification, there would be a little outrage.

Depends what his contract terms were. If 'be a mascot upon request' was part of it, he's in trouble, otherwise I'm fairly certain that you're not allowed to terminate a contract for refusal to perform a duty notdescribed in said document.

That said, the Santa thing probably had fark-all to do with the reason he was fired. In fact, I'd say that's fairly likely given the fairly friendly response to his refusal described in the bit ZAZ found. Asshat going after the people with money rather than the people at fault, as usual. Maybe he can hire Edwards to represent him ater this whole president thing falls through.

Except his religious beliefs (or lack thereof) say nothing about dressing up as santa clause. NO ONE who dresses up as santa clause actually believes in him and yet that doesn't stop them from doing so. Someone who dresses up as mickey mouse doesn't believe the bloody mouse actually exists in reality even if some of the kids may.

If I asked a Muslim to pain a picture of Mohammad they could argue it's against their religion. If I asked a Christian they could not because their religion says nothing about such things.

Hmm. At first I thought it was a Lebonese guy they fired for not dressing up in a Santa suit, which I thought was total crap. Turns out it's a guy from Lebenon Maine. Still crap.

Santa as a relegious icon can be argued. What with the 'Jolly Old St. Nick' alias Santa gets in North America at the least. But yeah, unless his contract said anything about having to dress up at any time in any costume then his firing was illegal.

Though Santa Claus has no religious meaning today, you must remember the background of St. Nicholas. Still, Santa remains a symbol of Christmas, a Christian holy-day.

no it wasn't. I said that it takes a certain type of person to make a Wal-mart (or Domino's), and you end up with policies in the stores that reflect the wills of the owners. get it?
