I understand "public," but it's not like he swung it out and did cartwheels with a neon pointing at it. If anything the attention of any onlookers was brought on by the foobs in plain sight of anyone walking by.

Keep in mind, this is the place where cops walk up on your porch and card you for holding a beer.
Think you're safe in the hot tub on your raised deck in your back yard? Maybe not. If the cops see you drinking and can get to you by walking up outside stairs, you better have your "Papers" ready.

SHE ASKED HIM TO! How is that not entrapment?? It would be one thing if he had just whipped out in the middle of their conversation, but the woman (who is an agent of the police) ASKED HIM TO. That is the definition of entrapment. Forgetting all that, doesn't this police department have anything better to do than wasting resources catching "perverts"?

First off, the people complaining of entrapment, it isn't a police officer asking someone to commit a crime, it's enticing a person that would normally not commit such a crime into doing it.

That said, it still could EASILY be argued as entrapment.

I mean seriously, you would be able to arrest 90% of the populace using this "sting".

If she was an agent of the police it would be entrapment. However, nothing in the story says she was employed or working with the police in any way.

Now, I am not a legal expert, but I did do a google search of entrapment and:

Entrapment: "Government agents entrapped him if three things occurred:

- First, the idea for committing the crime came from the government agents and not from the person accused of the crime.

- Second, the government agents then persuaded or talked the person into committing the crime. Simply giving him the opportunity to commit the crime is not the same as persuading him to commit the crime.

- And third, the person was not ready and willing to commit the crime before the government agents spoke with him.

On the issue of entrapment the government must prove beyond a reasonable doubt that the defendant was not entrapped by government agents. "


1) It was not his idea as it was suggested by the police.

2) It was the police officer who persuaded him to commit the crime through physical arousal and verbal manipulation.

3) Prior to speaking to the police he had no intentions of committing a crime.

Seems like entrapment to me. Someone with better knowledge of the law can add more to that.
