The Constitution was originally designed so that learned individuals appointed by committees, not duly elected through democratic processes, had the power. The Senate was appointed by the House, the President was appointed by the Electoral College, and the Supreme Court was appointed by the President with the advice and consent of the Senate.

Judging by the last sixty years or so, it was probably better that way.

2 of the justices on your list are dead. And not recently either. (Okay Sandra isnt dead yet, but as far as the court is concerned....)

And judicial activism isnt defined by overturning laws, its defined by "activily" legislating from the bench, as opposed to strictly applying the constitution and common law.

Its isnt judicial activism to overturn a law if that law is unconstitutional. Thats their job (in part).

That isn't usually the case. Take the whole Schiavo mess. The judges in that case followed the law and the Constitution and were labeled "activist" because they "defied the will of the people" and overturned one-off laws that were unconstitutional.

And, by the way, where do you think common law comes from?

It must be hard to be funny and a Supreme Court Justice. No matter what you say about the subject matter in front of you, someone is going to be offended.

"Roe vs. Wade? Well, we gotta make some law here, and you can't make an omelet without breaking a few eggs...what? What did I say? What's she crying about?"

But the "liberal" judges don't overturn laws they think are constitutional. That part is all a matter of interpretation.

I heard his bit on "Wait, wait don't tell Me". Breyer's pretty damn funny.

He was the junior justice for 12 years, and thus, had to do shiat duties like answer the door, bring coffee, etc. 12 farking years!
