Hold on, I'm all about the free speach bit, but the kid pulled this stunt at a school sanctioned event. If he wants to play hippie then he can do it when other people can't enforce their own rules. This kid hasn't got a leg to stand on, and I'm really surprised this has managed to reach the Supreme Court.

Well, if that's the case then this is just the preamble to one of the biggest personal injury lawsuits in history. If they violated his civil rights, and the SCOUTS says that's so, then I think you can safely go to court to sue for that very thing, and not worry about losing.

yes and rightly so. According to the article and what i have read, his family was more or less forced into exile, they deserve vindication at the hands of the state. Perhaps finally schools will realize that thier purpose is to educate, not to instill morals.

If the school district had simply apoligized and admitted to over-reacting none of this would have happened.

But it doesn't look like the school district has anything to apologize for. The kid's at a school sanctioned event, and decides to put up a pro-drug use banner. Seeing as how that is obviously not the school's stance on the issue, they take it down. It's not a violation of free speech, it's the school enforcing their own stance.

Again, if this kid wanted to play hippie outside of this event, and just chose a random day to put up his banner, no problem.

Wrong. This is possibly true for the bong-hitter, if the amount of discriminiation he claims to have faced actually took place. But the school and its representatives aren't misunderstood, they're just flat-out wrong. Irregardless of the importance of discouraging drug use, it is vastly more important to support the right to free speech this country was founded on. I fail to see why this fact is so hard for others to understand.

obviously when you are on school grounds you have no right to freedom of expression. i thought the courts have ruled on this type of case before?

im all for saving a few bong hits for jesus, but use common sense. the school isnt going to let you have your own opinion, your supposed to represent theirs.

I'm always amazed at people who want to yell "Free Speech! Free Speech!" and file lawsuits when something like this happens. What a waste of everyones' time and taxpayers' money. The kid pulled a dumb stunt; which I'm sure he thought was terribly clever. End of story. Now he wants to make a federal case out of it? (pun intended) His First Amendment rights weren't violated. The First Amendment protects people from government reaction or retribution when what they are saying is against said government; or not very nice about the government or its policies. It doesn't guarantee that someone will be able to say anything they want to say at all times. Maybe he missed that part of political science class while he was suspended.

the schools specific rule about promoting drugs is not relevant to anything. Simply because the school has a policy does not make it legal.

If a school demands human scarifices on fridays, human scrifices will still be illegal, and we would probably still be here having this very same conversation except about human sacrifices.

school have WAY too much power these days.

yeah, i remember in my high school's hand book basically said in print that parent's decisions and methods of parenting are suspended in favor of whatever the school says and the parent is expected to work with the school towards this goal etc.

it is certainly a matter of free speech...i dont understand how it isnt? He is being punished by the school ( a govt. institution) for "promoting" something that the school is in opposition to. It could be seen as a sort of protest, yet there was no profanity, "fighting words" were not uttered, there was no slander or libel involved (except perhaps on the part of the school) and normal classroom activites were not disrupted. Not to mention the event took place on private property (trespassing case?) i would think the only people with the right to remove such a banner would be the homeowners association.

this is most certainly a textbook example of censorship and a violation of free speech.
