Of course it does. There are easier ways to deal with it though. Simply enforce the noise ordinance. Or require a permit to get a keg of beer.

This would mean that 15 guests, each bringing a gift or bottle of wine worth more $7 each, would be considered a commercial event, in violation of the law.

The law was originally intended to protect homeowners from the unscrupulous renting of homes for large parties where ticket charges, sale of alcohol, large amounts of traffic, noise, garbage and other such annoyances are causing neighbors discomfort.


Sounds like the city wants their cut of taxes on ticket charges and sale of alcohol and cash for a commercial event permit fee.

I think it is BS. I mean if your disturbing the peace then you are disturbing the peace. If you have like 20 people over and not bothering anyone it shouldn't be anyone else's business.

Have these people looked at the prices on a bottle of wine these days? According to this law if you invite a guest to you house and they bring even a single Bottle of something like Opus One as a hostess gift, you are now hosting an illegal party and can be fined $1000?

Why do I think this law was passed with an unspoken codicil that it is intended only to be enforced on folk poorer and browner than those that passed it?

Basically this would just give the cops and the city yet another fine to tack on when they knock on your door due to noise complaints. I don't actually believe they would be raiding Christmas parties, but the press would be awesome.

...grandma got thrown into a SWAT van...on TV in front of our house Christmas eve...

Lots of places require a permit for a keg. College towns do this a lot. It doesn't restrict the amount you can purchase. It does send a very clear message to the person buying the keg though. Keep the party under control. Also lets police know where to do the drive by to make sure the party is under control.

The ordinance would preclude, even on private property, such events as Christmas parties, cocktail parties, birthday parties, barbecues if gifts are exchanged or food or drink contributed wherein and the total value of all gifts exceed $100.

This would open the door for everyone giving extremely cheap Christmas, birthday, wedding, anniversary etc. presents. Sometimes I wish we could just pull a Lorena Bobbit and disconnect the wiener that is Florida right off of the rest of the country.

In New York there is already a law stating that if you buy a keg of beer it must be returned in something like a week (someone who really know please post the facts). From what I understand it was instituted to curb keg parties and underage drinking. But the people who are really pissed about it are the old men who have a keg bar in their finished basement. They have to drink all that beer with their one drinking buddy and get the keg back or its fines for them!
