phrasing it like that makes it seem like mcdonald's didn't have a point, submitter. you wouldn't be allowed to be open a McComputerShop, either. and rightfully so; why would you be able to put a big yellow sign Mc... anything? why does mcdonald's not have a right to their intellectual property, because they're a big corporation?

what, you think you cant have "mc" in the name of a corporation? thats insane. I guess McAllisters is going to be sued any day now. I guess the real problem was the color scheme/signs alongside the name.

meanwhile, at McDowells:

Mr. McDowell (alarmed): They're not from McDonalds are they?

Seriously, IP stupidity like this is getting out of control. No one would confuse McCurry with McDonald's and they don't have exclusive usage of the letters Mc.

IP is a bargain with society - We make sure you have exclusive license to your works for a limited time and in exchange you turn it over to the public domain when time's up. Bitorrent, Napster, etc are a backlash against corporations who are unwilling to hold up their end of the bargain.

And if the judge found that the case had grounds, it also could have been used against them if they DIDN'T sue.

Why else would McDonalds piss money away at this? Five years of legal battles are not cheap!

Theoretically, he shouldn't even need to, the man is the HEAD of the clan McDonald. Every McDonald answers to him. In theory at least. I was hoping MickeyD's would push the issues, I was looking forard to a good old fashioned Scottish clan-war.

While I think this is stupid, and would normally side with the Malaysian fellow over the "Malyasian Chicken Curry", look at the sign. M is capitalized, but the first C for chicken is not. Maybe somewhat irrelevant, but shouldn't both be capitalized if each letter stands for a word? Seems like the guy is grasping at straws after he lost. What difference does the name of the place make anyway if he wasn't drawing business based on people mistaking it for a subdivision of McDonalds?

Of course, the guy could have a poor handle on the English language too. It's not like we're known for a having a language that makes sense.

The colours and the lettering used in the sign could easily be confused with a McDonald's restaurant signage.

If this is real - and I was a judge - I'd agree too:

1.) The name is grandfathered - the cafe came first.
2.) The name is personal, so they have a legitimate claim to it.
3.) Just for the hell of it.. I might reverse the ruling, awarding the damages to the cafe owner - instead of to McDonald's, like the greedy b@$t4rd$ wanted.

On another point.. isn't "Mc" generally Irish, and "Mac" Scottish? Or is the other way around?

When a maker of electronic voting machines attempts to use the DMCA to quash the publication of discovered memos (sp?), which speak of possible flaws - without court intervention (just cease and desist letters), on a matter that could jeopardize what little say-so we seemingly have left in our country - I'd say that, indeed, "IP stupidity is getting out of control!"

McDonalds gets copyright to "Mc" worldwide. It is believed that all people with the sirname of "Mc" will be sued and forced to change name to "Mk" until the new chain of fast food resturaunts "MkDonalds" is founded.
