Missouri is a police state?

musicmanboston: Missouri is a police state?

Theoretically, under the original constitution, any state could be a limited police state as long as they don't deny people the rights in the federal Constitution.

beerdiva 2006-02-23 12:09:41 PM
yeah, not only do some cities requier occupancy permits(a way to get an extra $25-$100 depending on the city). more of an unfair tax on renters, but many cities require them.

musicmanboston: Missouri is a police state?

Apparently yes, since they have taken it upon themselves to tell heterosexuals whom they can live with and what constitutes a family.

There are so many funny names in that article, I just about lost it.

The article doesn't mention it, but I assume this is government subsidized housing? In which case, this is pretty common. Here in Dublin, they have cheap government housing for single mothers, but as soon as said single mother gets a live-in boyfriend, she has to go get her own place (theoretically, two incomes should be able to afford a place to live... but in this city? Yikes!)

And if it's not government housing, since when does the city get to determine who does and doesn't live in a given home???

antifuse: since when does the city get to determine who does and doesn't live in a given home?

Just a guess, here, but that happens when religious zealots take it upon themselves to "educate" their neighbors on what they call "morals."

Me, I see it as extreme hypocrisy.

I see nothing wrong with this. If the unwed are allowed to occupy the same domicile, next thing you know people will be marrying their dogs!

Missouri is just Arkansas with shoes.

Actually, a lot of counties enact statutes like this to keep college kids from moving in and partying. If unmarried couples are allowed to move in, what's to stop me and a bunch of my buddies moving in?

Kind of asinine, but that's why they do it. Mainly to keep kids out.

This couple is really threatening the sanctity of my own marriage. I'm struggling with every muscle in my body not to pick up the phone and tell my wife I want a divorce.

tarrant84 2006-02-23 12:35:17 PM
I would be willing to bet that this statute was enacted from keeping a bunch of kids from renting apartments.

They have them all over where I live. Not because anyone wants you to lead a good, moral, Christian life, but because they don't want kids coming in and partying.

Come on. Let's be realistic here.

No, to do that, they just specify a minimum income level... (seriously). The place I used to rent said you had to make over 40k a year.

Love note to all the Missouri folks who voted to ban gay marriage: You reap what you sow, biatches.

Go ahead, fight the occupancy issue in court, let's see what happens.

It's poverty around where I lived at the time (Philly suburb), but it kept out the people they didn't want to rent to...

What's with all the gay marriage claptrap? As far as I can tell, Olivia is female and Fondray is male. Not that this wouldn't apply to same-sex couples doing the same thing, but keep on-topic, shall we?

tarrant84 2006-02-23 12:42:28 PM
sigdiamond2000: Damn. That doesn't seem fair.

Meh, on the flipside, how would you feel if 10 college kids decided they wanted to live next door to you and split an apartment? Especially if you had to be up at 7:30am for work...

So while some of these statutes seem arbitrary and even discriminatory, it's to protect the renters in most cases.

Occams_Electric_Razor 2006-02-23 12:45:03 PM
stevarooni: What's with all the gay marriage claptrap?

I think the original poster's intent was that by allowing the government to dictate the terms of homosexual relationships they've been given the de facto power to dictate the terms of all relationships, now.

Aren't there already laws against excessive noise at certain hours, and such? Why do we need more laws?

You're talking about occupancy limits. This case seems more to do specifically with freedom of association.

tarrant84 2006-02-23 12:49:48 PM
ArcadianRefugee: Aren't there already laws against excessive noise at certain hours, and such? Why do we need more laws?

Which still didn't stop you from being woken up at 1AM on a Tuesday night, having to wait for the police, and making you say "Gee, I wish I would have rented somewhere else."

The landlord has rights, too.

Action Replay Nick: You're talking about occupancy limits

You could set the occupancy limit to like 3 or 4, but then you have the problem of young people who still move in an do the same thing-- their parents foot the bill, or they're recent graduates.

This kind of thing runs rampant where I grew up. My cousin is 28 and couldn't rent in a lot of places because he was a young, white, unmarried guy living with a few friends.

Chook Cheek 2006-02-23 01:28:37 PM
Occupancy permit? If a landlord doesn't want to rent his place to someone, let him decide not to rent to "a bunch of kids." If someone is too loud, the police can fine them. There is no need for this silly law.

You could set the occupancy limit to like 3 or 4, but then you have the problem of young people who still move in an do the same thing-- their parents foot the bill, or they're recent graduates.

So, are they supposed to live on the street? What's wrong with 3 or 4 recent graduates sharing a place? If they are a nuisance the police will deal with them and the landlord will evict them. It might inconvenience some people, but then again a family or a single person may be a nuisance too, and it will be just as inconvenient.

I could maybe understand occupancy limits, but requiring occupancy permits that judge your fitness based on relationships to other occupants is going too far.

ArcadianRefugee 2006-02-23 01:54:18 PM
tarrant84: Which still didn't stop you from being woken up at 1AM on a Tuesday night, having to wait for the police, and making you say "Gee, I wish I would have rented somewhere else."

So in order to prevent something from happening once or twice because of assholes (who aren't likely to follow law Y if they arent gonan heed law X), we have a law that stops otherwise law-abiding citizens from simply living peacefully? Yeah, smart.

Kinda like saying "well, some people drive like assholes, so cars aren't allowed in the state". Sorry. I'm not big on the "screw over 99 people to stop the 1 guy from being a dick" rules.

heap 2006-02-23 02:04:13 PM
no 'common law' rules in the area, i take it?

lukelightning 2006-02-23 02:30:54 PM
Seems fair to me; to balance out banning gay marriage you have to ban straight cohabitation. Now everybody is miserable!

MizzouGuy 2006-02-23 02:32:05 PM
No news here, nothing to do with gay marriage, unwed couples, etc. They just don't want a bunch of people renting an apartment, mainly youngin's, who are going to trash the place.

tonesskin [TotalFark] 2006-02-23 02:32:09 PM
The same city code in most places in Alabama says Blood and Marriage. I'm sure some out-of-towners pointed out the "mistake" only to be told that it was there purposely.

eX7 2006-02-23 02:33:52 PM
You know what? If the kids want to all move into a home and party, fine. But just wait until the noise ordinances force them to pay hefty fines and get evicted. I think this situation where they can't live together is rather stupid and uncaring.

Meh, I would go over to their place and kindly ask them to keep it down after 10:00 P.M. Sunday through Thursday. Gently explaining that some of us have to work. Now most people would respond correctly to this, but I have had a few asshats that were like fark you old guy.

Then they had a little run in with mister ball bat. After some dude in a black mask beats the living fark out of them yelling all the while "I said quite!" they get the hint, or move.

This is funny.

I suggest they move to Oklahoma or Arkansas. Nobody seems to mind that sort of thing there. You can buy a nice used trailer home for less than 1000 bucks and be all set.

just kat [TotalFark] 2006-02-23 02:42:48 PM
heap - I was thinking the same thing, what about common law marriages? is that a myth? and to rule out blood because ONE of the kids wasn't his? that is a technicality that shouldn't even be within the rules. That said, the rules are totally ridiculous. All the excuses put forth here so far to justify it are using an elephant gun to swat a fly. In your lease you (as the landlord) put strict rules. Enforce them. End of story.

I can understand the arguement that they don't want a ton of college students moving in and trashing the place, but that's what deposits and lawsuits are used to fix; if the college guys cause noise complaints, evict them.

You have to love the mayor's name though.

And if it's not government housing, since when does the city get to determine who does and doesn't live in a given home???

Tallahassee has a Roominghouse Ordinance that says 4 people unrelated can't live together unless they are in a registered roominghouse ($259/year).

It's impossible to enforce.
